1. Eligibility & Acceptance

You must be at least 18 years old and a resident of India to use GERAZ. By ticking the consent checkbox at sign-up and continuing, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Services. GERAZ reserves the right to verify your eligibility at any time and to suspend accounts that do not meet these criteria.

These Terms constitute a legally binding agreement between you and GERAZ ENTERPRISES PRIVATE LIMITED. If you are using the Services on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.

2. The Services

GERAZ provides subscription-based roadside assistance services for four-wheeled motor vehicles in Gujarat, India. Under an active subscription, members may request emergency assistance (towing, battery jump-start, tyre change, fuel delivery, lockout assistance, and related services) by raising a job through the GERAZ user application. Jobs are dispatched to the nearest available GERAZ patrol driver; if none is available within range, dispatch falls back to the nearest registered GERAZ garage partner.

GERAZ also offers on-demand and subscription-based car-wash and vehicle care services ("Car Wash") bookable through the same user application. Car Wash services are subject to availability in your area and may be governed by additional terms presented at the time of booking.

Service availability is subject to geographic coverage, weather conditions, traffic, and the availability of responders. GERAZ does not guarantee a specific response time, although we endeavour to dispatch a responder as promptly as operationally possible. Response times shown in the app are estimates only.

3. Accounts & Authentication

To use the Services you must create an account using a valid Indian mobile phone number, verified through a one-time password (OTP). You are responsible for maintaining the confidentiality of your device and account session. You must not share your account with others or allow any third party to use your account. You agree to notify GERAZ immediately at info@geraz.in if you suspect any unauthorised access to your account.

GERAZ creates responder (patrol driver and garage partner) accounts on an invitation-only basis — there is no self-registration pathway for responders. If you are a garage partner or patrol driver, your account is governed by the separate Responder Agreement in addition to these Terms.

You are solely responsible for all activity that occurs under your account. GERAZ will not be liable for any loss or damage arising from your failure to keep your account secure or from your failure to notify us of a security breach.

4. Subscriptions, Callouts & Billing

Access to roadside assistance requires an active GERAZ subscription. Subscription plans (Basic, Standard, and Premium), their prices, included callout limits, and covered services are displayed within the app at the time of purchase and are subject to change at our discretion with reasonable notice. One subscription covers all vehicles registered under your account; callout allowances are shared across those vehicles.

Subscriptions are billed annually. Where you have set up an auto-renewal mandate through Razorpay, your subscription will renew automatically at the then-current renewal price unless you cancel before the renewal date. GERAZ will send renewal reminder notifications at least seven days and one day before your subscription's expiry date. If an auto-renewal payment fails, your subscription enters a seven-day grace period during which the Services remain accessible; if payment is not successfully collected within the grace period, your subscription will be suspended until payment is received.

A callout is reserved (deducted from your allowance) at the moment you create a job request, not at job completion. If you cancel a job before any responder accepts it, the callout is refunded to your allowance. Callouts used for jobs that are accepted, in progress, or completed are not refunded. Unused callouts do not carry over to a new subscription period.

5. Cancellations & Refunds

You may cancel your subscription at any time through the app or by contacting info@geraz.in. The refund amount applicable upon cancellation is calculated according to the refund schedule displayed in the app at the time of your cancellation request, which takes into account the number of days remaining and the number of callouts used. Refunds, where applicable, are processed back to the original payment method via Razorpay within 7–10 business days.

Individual service bookings (such as Car Wash) have their own cancellation windows, which are displayed at the time of booking and at the point of cancellation. No refund is available for cancellations made after the cancellation window has closed or for no-shows.

6. Acceptable Use & User Responsibilities

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must provide accurate and complete information when registering your account and adding vehicles. You must ensure that you have lawful access to any vehicle for which you request assistance, and that the vehicle is a four-wheeled motor vehicle manufactured within the last 15 years (vehicles older than 15 years are not eligible for GERAZ coverage).

You must not use the Services to make false, abusive, or fraudulent service requests; to harass, threaten, or harm GERAZ personnel, patrol drivers, or garage partners; to attempt to reverse-engineer, modify, or interfere with the GERAZ applications or backend systems; or to circumvent any security, authentication, or rate-limiting controls.

GERAZ reserves the right to investigate suspected violations and to suspend or terminate accounts found to be in breach of these obligations. You may be held liable for losses suffered by GERAZ or third parties as a result of your misuse of the Services.

7. Responders & Payments

All payments for GERAZ Services — subscriptions, callout fees (if any), car-wash bookings, and any other charges — are made exclusively to GERAZ ENTERPRISES PRIVATE LIMITED through the in-app payment flow powered by Razorpay. Patrol drivers and garage partners ("Responders") are not authorised to collect any payment directly from you. If any Responder requests payment from you directly, please refuse and report it immediately to info@geraz.in.

GERAZ is responsible for settling amounts owed to Responders in accordance with our separate Responder Agreements. The Services you receive from Responders are facilitated by GERAZ; however, GERAZ is a technology platform and service aggregator, and the actual roadside assistance or car-wash work is carried out by the Responder. GERAZ's liability for the acts or omissions of Responders is limited as described in Section 8.

8. Disclaimers & Limitation of Liability

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, GERAZ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. GERAZ does not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that response times will meet any specific threshold.

To the fullest extent permitted by law, GERAZ's total aggregate liability to you for any claim arising out of or relating to these Terms or the Services — whether in contract, tort, negligence, or otherwise — shall not exceed the total subscription fees paid by you to GERAZ in the twelve months immediately preceding the event giving rise to the claim. In no event shall GERAZ be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

9. Indemnity

You agree to indemnify, defend, and hold harmless GERAZ ENTERPRISES PRIVATE LIMITED and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your breach of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any inaccurate information you provided to GERAZ. GERAZ reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with GERAZ in asserting any available defences.

10. Suspension & Termination

GERAZ may suspend or terminate your access to the Services, with or without notice, if we reasonably believe that you have breached these Terms; your subscription payment has failed and the grace period has expired; your account or vehicle information is fraudulent or inaccurate; or we are required to do so by law or court order. Upon termination, your right to use the Services ceases immediately, and any unused subscription value will be handled in accordance with our refund policy (Section 5).

You may terminate your account at any time by contacting info@geraz.in. Termination does not relieve you of any payment obligations that accrued prior to the termination date.

11. Changes to These Terms

GERAZ reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this document and provide an in-app notification. Your continued use of the Services after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services and may request account deletion in accordance with our Privacy Policy.

12. Governing Law & Contact

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Gujarat, India.
